Welcome to Mzansi Motive. In these Terms, “we”, “us” and “our” refer to Mzansi Motive. By visiting or purchasing from mzansimotive.com (the “Services”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.
1. Eligibility. By using the Services you confirm that you are at least 18 years old, or are using the Services with the consent of a parent or guardian, and that the information you provide is accurate and complete.
2. Products. We make every effort to display our products accurately, but colours and appearance may vary depending on your device. We may change or discontinue products, and limit quantities, at our discretion.
3. Orders. When you place an order you are making an offer to purchase. We may accept or decline any order at our discretion, and your order is only accepted once we confirm it and receive payment. We may be unable to cancel an order once accepted.
4. Prices and payment. Prices are in South African Rand (ZAR) and may change without notice. The price charged is the price shown at the time you order, as set out in your confirmation. You warrant that the payment details you provide are valid and that you are authorised to use them.
5. Shipping and delivery. Delivery times are estimates and are not guaranteed. Please see our Shipping Policy. Risk in the products passes to you on delivery to the carrier.
6. Returns. Purchases may be returned or exchanged in line with our Refund & Returns Policy and your rights under the Consumer Protection Act.
7. Intellectual property. The Services, including all text, images, graphics, logos and their arrangement, are owned by Mzansi Motive or its licensors and are protected by South African and international copyright, trademark and other intellectual property laws. You may not reproduce, distribute or exploit any part of the Services without our written consent.
8. Third-party links. The Services may contain links to third-party websites. We are not responsible for their content or practices, and you access them at your own risk.
9. Disclaimer of warranties. Except as expressly stated by us or required by law, the Services and products are provided “as is” and “as available” without warranties of any kind. Nothing in these Terms excludes any rights you have under the Consumer Protection Act that cannot lawfully be excluded.
10. Limitation of liability. To the fullest extent permitted by law, Mzansi Motive is not liable for any indirect, incidental or consequential loss arising from your use of the Services or products. Nothing limits liability that cannot lawfully be limited.
11. Indemnification. You agree to indemnify Mzansi Motive against claims, damages and costs arising from your breach of these Terms or your misuse of the Services.
12. Governing law. These Terms are governed by the laws of the Republic of South Africa, and you consent to the jurisdiction of the South African courts.
13. Changes. We may update these Terms from time to time by posting the revised version on this page. Your continued use of the Services means you accept the changes.
